California AB 723 took effect January 1, 2026. This law requires disclosure when listing photos have been materially altered through digital manipulation in a way that misrepresents the physical condition or features of the property. That includes virtually staged rooms presented as furnished, significant structural alterations, and AI-generated content that misrepresents the property.
Sky replacement is not considered a material alteration requiring disclosure. Replacing a flat gray or overcast sky with a natural blue sky is cosmetic correction of natural conditions — the same way a photographer corrects exposure or color balance. It does not misrepresent any physical feature of the property.

Virtually staged rooms presented as physically furnished
Significant object removal that misrepresents the property condition
AI-generated content that alters physical features of the home
